Our General Terms and Conditions (GTC)

For the Hamburger Kunsthalle’s online ticket shop

 

The online sale of admission tickets to the Hamburger Kunsthalle (hereinafter also referred to as the ‘Provider’) to the visitor (hereinafter also referred to as the ‘Customer’) is governed exclusively by the following terms and conditions.

 

1. Contracting party

2. Conclusion of the contract
The offerings in the online ticket shop are non-binding and do not constitute a legally binding offer, but rather an invitation to place an order. By clicking the ‘Buy now’ button in the final step of the ordering process, you are making a binding declaration that you wish to purchase the items in your shopping basket. Before submitting the order, the Customer may view and amend the details at any time. However, the order request can only be submitted and transmitted if the Customer accepts these terms and conditions by clicking the ‘Accept T&Cs’ button, thereby incorporating them into their request. The contract of sale is concluded when we accept your order by sending an order confirmation via email immediately upon receipt of your order. Upon booking, the Hamburger Kunsthalle reserves the right to send you important information both before and after your visit.


3. Admission tickets
Entry to the exhibition spaces of the Hamburger Kunsthalle is only permitted with a valid ticket. Children and young people up to and including the age of 17 are admitted free of charge. When purchasing concessionary tickets, proof of eligibility must be presented without being requested to do so, together with the admission ticket, upon visiting the Hamburger Kunsthalle. Should it transpire that the grounds for the discount do not apply at the time of the visit, the Customer is not entitled to a refund, but must instead purchase a suitable ticket for their visit to the Hamburger Kunsthalle.

Tickets for public guided tours are valid only for participation in the public guided tour booked. A valid admission ticket for the specific day of the tour must always be purchased separately in order to visit the Hamburger Kunsthalle.

For certain special events, a museum ticket is included in the price. This is explicitly stated for the relevant events.

4. Loss of admission tickets
In the event of the loss of an admission ticket, there is no entitlement to a replacement ticket or any other form of compensation.


5. Gift certificates
Gift certificates can be redeemed at the museum ticket office and in the online ticket shop. They are valid for three years; the validity period begins at the end of the year in which the respective gift certificate was purchased. The credit cannot be paid out in cash. Gift certificates may be partially redeemed. If a gift certificate is lost, it cannot be replaced.


6. Entry and admission entitlement
The admission ticket entitles the holder to entry during opening hours (current opening hours can be found at www.hamburger-kunsthalle.de). Special admission tickets are required for special events, whether held during or outside regular opening hours. The admission ticket is valid for one day only and entitles the holder to entry to the Hamburger Kunsthalle on a single calendar day. It becomes invalid upon entry to the museum and once it has been validated. Admission tickets are non-transferable once entry has been granted. Admission tickets that have been forged or otherwise tampered with do not entitle the holder to entry and will be confiscated by the Hamburger Kunsthalle, without replacement or compensation. The same applies in the event of the misuse of admission tickets.
The Hamburger Kunsthalle is entitled to close off areas of the museum, either in whole or in part, or to restrict access to them. Such closures or access restrictions do not give rise to any claims on the part of the visitor.

7. Cancellation/Right of withdrawal
When purchasing our admission tickets, event tickets and online tickets for our holiday programmes, the right of withdrawal pursuant to Section 312g(2)(9) of the German Civil Code (BGB) does not apply. There is therefore no entitlement to exchange or return purchased admission tickets and online tickets. Exception: The statutory 14-day right of withdrawal applies to gift certificates purchased. Further details can be found in the withdrawal policy at the end of these Terms and Conditions.

8. Prices
All prices are final prices in euros. The prices applicable are those indicated at the time of booking.

Services provided by museums, such as the Hamburger Kunsthalle, are exempt from VAT in accordance with Section 4 No. 20(a) of the German Value Added Tax Act (UStG).

9. Payment
The Customer selects their preferred payment method from those displayed. The subsequent confirmation of the amount via the system, together with a request to complete the payment, constitutes acceptance of the offer.

10. Order confirmation
Following payment, the Customer will receive a saveable and printable order confirmation, including a QR code and a PDF ticket.

11. Data protection
Please refer to the Privacy Policy of the Hamburger Kunsthalle.

12. Operation of the website and online ticket shop
The Hamburger Kunsthalle endeavours, insofar as this is technically possible by reasonable standards, to ensure that its website operates free of errors and interruptions. However, the Hamburger Kunsthalle cannot guarantee this.

13. Final provisions
Contracts between the Provider and Customers are governed by the law of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Where the Customer is a merchant, a legal person governed by public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the Customer and the Provider shall be the Provider’s registered office.

Even if individual provisions are legally invalid, the remaining provisions of the contract shall remain binding.


Right of withdrawal
You have the right to withdraw from the contract for the purchase of a gift certificate within fourteen days without stating any reason.

The withdrawal period is fourteen days from the date the contract is concluded.


Exercising your right of withdrawal
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. by email or letter to the address given below).

Withdrawal via the online withdrawal function: You may also exercise your right of withdrawal online via the withdrawal function provided in the ticket shop on our website at [insert web address of the withdrawal function]. To do so, click on the button labelled “Withdraw from contract”. You will then need to enter your name, the details of the relevant contract (order number) and your email address for the confirmation of receipt. By clicking the “Confirm withdrawal” button, your notice of withdrawal becomes binding. If you use this online function, we will immediately send you a confirmation of receipt on a durable medium (e.g. by email), containing information on the content of the notice of withdrawal as well as the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period expires.


Consequences of withdrawal
If you withdraw from the contract for the purchase of gift certificates, we must refund all payments we have received from you without delay and at the latest within fourteen days of the day on which we received notification of your withdrawal from the contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.
